Terms and Conditions
1. Definitions
“Company” (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Cleaning Mint.
“Services” refers to the Company’s services or any services on the website.
“You” or “Your” refers to the individual, people or organization that uses our Services or owns an account with one or more of our Services.
“Cleaners” refer to third party cleaners, including but limited to individuals, teams or companies who are not affiliated with the Company, which provide cleaning services.
“Agreement” refers to this Terms of Service.
“Website” refers to cleaningmint.com.
2. Usage
By using or receiving any of our Services, now or in the future, you hereby agree to the latest Terms and Conditions and any future amendments. That is true for any of our existing and future services or products that we add to our Services over time. There may be times when we do not exercise or enforce any right or provision of the Terms and Conditions; in doing so, we are not waiving that right or provision. We may update these Terms and Conditions in the future. Whenever we make changes to this Agreement, it will also be made available on our Website. It is your responsibility to review and stay up to date on this Terms and Conditions. These terms do contain a limitation of our liability.
If you violate any of the terms, we may terminate your account and cancel appointments and services, including any third party services. You are responsible for any and all pending payments and fees.
3. Service Overview
Cleaning Mint is a platform that allows customers to schedule cleaning appointments and third party cleaners to accept and complete the cleaning service. The company does not provide cleaning services nor is it a cleaning service provider, and therefore your premise shall be cleaned by third party cleaners with their supplies and equipment. We are not liable for any cleaning services rendered by third party cleaners.
Cleaners shall arrive at the destination appointment arrival window. Although cleaners make every effort to arrive promptly, there may be unforeseen circumstances that may delay the arrival.
In order for the cleaners to provide excellent cleaning services, we ask that you clear the areas to be cleaned prior to arrival. Cleaners shall do the best to move light and small items in order to clean. We ask that you secure away any fragile or precious items that are or may be prone to damage. You understand expressly that we are not liable for damages for such items that are not secured away.
We love pets and ask that you inform us of any pets in the premise to be cleaned. For the safety of your pets and cleaners, we ask to secure any pets before and during the cleaning. Securing your pets is important to prevent your pets from escaping the premise as we enter to clean. We are not liable for any pet escapes.
For the safety of your home and cleaners, cleaners cannot clean areas that require moving heavy furniture and objects, climbing a ladder or out of reach with cleaning equipment. Additionally, for the safety of the cleaners, we cannot clean any areas or items deemed hazardous cannot be cleaned, including but not limited to broken stairways, unstructured flooring, insecure lighting fixtures, flooding, fire, electrical hazards, and biohazards such as needles, urine, blood or feces. In the event that the cleaning premise is deemed unsafe for the cleaners to enter or be present, the cleaners shall exit the premise.
We value your time and the best shall be performed to clean and meet your expectations. If you are not satisfied with the clean, let us know and the cleaners come back to take care of it for free. However for areas with severe grime or buildup, the standard cleaning may not be sufficient, which would not be eligible for a partial reclean. We recommend starting with a deep cleaning service or scheduling a deep cleaning for your next appointment for optimal results. In some cases, additional professional services may be required to address extreme areas depending on the severity of the buildup.
4. Payment
All services performed by the Company at your request are charged according to our flat-rate pricing plus any optional extras included upon booking. Our booking pricing is shown in United State Dollars. You agree to pay the full price of the cleaning service upon booking an appointment. When you book an appointment with the Company, you are explicitly approving such third party cleaning services to be performed at the address that you have specified without the need of other written or verbal confirmation to proceed with the third party cleaning service. It is understood and you agree that the premise that the cleaners shall enter to clean is under your possession or that you reside in, and explicitly acknowledged that the cleaners can enter the premise legally. We accept credit cards as the only form of payment. Upon your booking, a credit card authorization will be placed on your card. Your booking is not finalized until you receive an email confirmation. Once the cleaning has completed, your credit card will be charged the full amount. In the event that your credit card could not be processed, you must make all attempts to remedy and provide an acceptable form of payment. Interest may be applied to overdue accounts at a rate of 5% per week. When payment has not been received, we reserve the right to withhold any and all Services. Any prolonged payments not received by the Company shall be sent to a collection agency, including any collection fees.
5. Cancellation and Rescheduling
If you need to cancel or modify an appointment, we ask that you inform us as soon as possible by contacting us by email, phone or text message.
A $100 fee will be applied for appointments canceled within 24 hours. Any cancellations made on the cleaning day will be charged the full appointment price. Any modification such as rescheduling an appointment within 24 hours shall be charged a $100 fee. You agree to pay the full amount of the cleaning if the cleaners cannot enter your home to clean.
We make every effort to avoid cancellations, but due to unforeseen circumstances we reserve the right to cancel an appointment. We shall make every attempt to notify you of the inconvenience as soon as possible. In the event that the cleaning premise is considered unsafe for the cleaners, the cleaners shall exit the premise, cancel the appointment and you shall be charged the full amount of the scheduled cleaning service.
6. Refunds
Once a cleaning Service has started, we do not provide refunds. If for any reason you are dissatisfied with the cleaning, you must notify the Company within 48 hours. We will offer a revisit to clean the areas that you were dissatisfied with. If you do not contact us within 48 hours after the initial cleaning was completed, then you surrender any resolutions.
7. Account Terms
a) You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
b) You are responsible for all information and content posted, and activity that occurs under your account. That includes information and content posted by others who either: (1) have access to your login credentials; or (2) have their own logins under your account.
c) You must be a human. Accounts registered by “bots” or other automated methods are not permitted.
8. Uptime, Security, and Privacy
a) Your use of the Website is at your sole risk. We provide this Website on an “as is” and “as available” basis. We do not offer service-level agreements for most of our Services.
b) We reserve the right to temporarily disable your account if your usage significantly exceeds the average usage of other customers of the Services. Of course, we shall reach out to the account owner before taking any action except in rare cases where the level of use may negatively impact the performance of the Service for other customers.
c) We take many measures to protect and secure your data through backups, redundancies, and encryption. We enforce encryption for data transmission from the public Internet. There are some edge cases where we may send your data through our network unencrypted.
- When you use our Website, you entrust us with your data. We deeply value that trust. You agree that the Company may process your data as described in our Privacy Policy and for no other purpose. We can access your data for the following reasons:
- Arrange cleaners to your home for a cleaning appointment. We need your home information to send cleaners to you.
- To help you with support requests you make. We may access your account and data to assist you.
- On the rare occasions when an error occurs that stops an automated process partway through. We may get automated alerts when such errors occur. When we can fix the issue and restart automated processing without looking at any personal data, we do. In rare cases, we have to look at a minimum amount of personal data to fix the issue. In these rare cases, we aim to fix the root cause as much as possible to avoid the errors from reoccurring.
- To safeguard the Company. We shall look at logs and metadata as part of our work to ensure the security of your data and the Website and Services as a whole. If necessary, we may also access accounts as part of an abuse report investigation.
- To the extent required by applicable law. As a US company with all data infrastructure located in the US, we only preserve or share customer data if compelled by a US government authority with a legally binding order or proper request under the Stored Communications Act. If a non-US authority approaches Cleaning Mint for assistance, our default stance is to refuse unless the order has been approved by the US government, which compels us to comply through procedures outlined in an established mutual legal assistance treaty or agreement mechanism. If Cleaning Mint is audited by a tax authority, we only share the bare minimum billing information needed to complete the audit.
- We use third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Services.
- Under the California Consumer Privacy Act (“CCPA”), Cleaning Mint is a “service provider”, not a “business” or “third party”, with respect to your use of the Services. That means we process any data you share with us only for the purpose you signed up for and as described in these Terms and Conditions, Privacy Policy. We do not retain, use, disclose, or sell any of that information for any other commercial purposes unless we have your explicit permission. You agree to comply with your requirements under the CCPA and not use the Company’s Services in a way that violates the regulations.
- Certain information and data uploaded by you may be temporarily cached to use of these Services.
9. Copyright and Content Ownership
a) All content posted on the Services must comply with U.S. copyright law.
b) We claim no intellectual property rights over the material you provide to the Services. All materials uploaded remain yours.
c) We do not pre-screen content, but reserve the right (but not the obligation) in our sole discretion to refuse or remove any content that is available via the Service.
d) The names, look, and feel of the Services are copyright© to the Company. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, content or visual design elements without express written permission from the Company. You must request permission to use the Company’s logo or any Service logos for promotional purposes. Please email us requests to use logos. We reserve the right to rescind this permission if you violate these Terms and Conditions.
e) You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services, use of the Services, Website, or access to the Services without the express written permission by the Company.
f) You must not modify another website so as to falsely imply that it is associated with the Services or the Company.
10. Feedback
We welcome feedback and can be submitted to us by email. We exclusively own all rights, title and interest to any feedback, requests, suggestions, recommendations, enhancements and ideas provided by you.
11. Liability
You understand and agree that the Company’s liability to any and all damages is limited to the dollar amount of the scheduled cleaning service. The Company is not liable for any damages due to fragile, delicate or precious areas or items not secured away, including but not limited to areas or items that have already been damaged or prone to damage.
You expressly understand and agree that the Company shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, compensation, loss, damage lost profits, special, consequential, punitive or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Company has been advised of the possibility of such damages).
12. Indemnity
You agree to indemnify and hold the Company and its owners, officers, directors, employees and agents harmless from any and all claims, losses, expenses, lawyer fees, and liability due to or in regards to the use of the Services or any violation of any terms in this Agreement.
13. Dispute Resolution
Any dispute, controversy, or claim arising out of, relating to, or in connection with this Agreement shall be resolved by mediation. The parties agree to seek to reach agreement within 30 days after the initiation of the mediation.
